First, don't expect any resolution over the phone. Your best bet is to take your husband to the dealership in the morning and ask to speak with the general manager or whomever is in charge.

State your case in an intelligent, non-emotional manner and ask for your money back politely. If you get absolutely no satisfaction, spend the $50 or so and take them to small claims court (Dan818 is right!). Realistically, that is pretty much your only option. But remember: try hard not to make a scene at the dealership because that will only give them an excuse to deny you.

So far they are still putting us off. We are in Raleigh, NC, and had tickets to game 7 of the Stanley Cup finals, so our attention has been slightly diverted until today.

We will have to go by there tomorrow and cause a fuss. Sigh. At least dealer #2 has come through and that FJ should be here by the end of this week or beginning of next.

Although it's been a week since you were headed back to the dealer, I'd thought I'd throw in my two cents, FWIW. The advice you've received has been excellent. The key, I think, to being taken seriously is to mmaintain a demeanor of being resolute but dispassionate. Then, your threat to go to small claims court will sound credible. Moreover, you can up-the-ante by telling the dealer that if your deposit is not returned immediately, your suit will be for the damages you've sustained from the dealer's fraudulent misrepresentation and intentional infliction of emotional distress. By adding in these additional grounds, you will have converted the matter from a $250 issue to one that is at the limit of the small claims court jurisdiction in your State. No dealer in his or her right mind is going to want to bear the legal costs to defend itself in order to hold on to $250. (Find out that limit before having that discussion and you will sound that much more credible.) If moral suasion hasn't worked, the foregoing gambit may save the day and its entirely legitimate.

Finally, don't beat yourself up for having trusted these people. It happens to all of us. Good luck.

After much calling, phone tag, etc., we managed to get the deposit back. And no threatening was needed. Whee!
